Birbal due back in court

A teacher accused of having sex with two of his former students plans to make a constitutional motion ahead of his trial.

Andre Birbal’s trial was due to start before Justice Roy Jones yesterday. However, Jones is presently hearing another case.

Birbal is set to appear before Jones on Wednesday for the hearing of the constitutional motion. The trial could begin on Monday if the pre-trial motion is concluded.

Prosecutors alleged that Birbal, of Trinidad, had sex with two students from the Eight Mile Rock High School during a period that spanned 2002 to 2007.

The Court of Appeal overturned his conviction and 35-year sentence after finding that mistakes made by the original trial judge Hartman Longley amounted to a serious miscarriage of justice.
